Element shouldn't be add to Gross but must taxable

I'm working for us legislation. I have the one requirement where "Tax Tuition Assist" element, whenever you pay this element, it should not be added to Gross Amount, But it shoud be taxable with subject to Federal and State income taxes.
How do you handle it..Any suggestion / Comments are welcome.
